Redfin rejoices."},"content":{"rendered":"<p><div id=\"attachment_16586\" style=\"width: 310px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-16586\" class=\"size-medium wp-image-16586\" src=\"http:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/wp-content\/uploads\/2020\/08\/BHBNewTopImage-300x225.jpg\" alt=\"Ya think it's easy?\" width=\"300\" height=\"225\" srcset=\"https:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/wp-content\/uploads\/2020\/08\/BHBNewTopImage-300x225.jpg 300w, https:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/wp-content\/uploads\/2020\/08\/BHBNewTopImage.jpg 320w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><p id=\"caption-attachment-16586\" class=\"wp-caption-text\">\u201cTreats for trouble is how you get more\u00a0trouble.\u201d<\/p><\/div>I saw Housing Wire&#8217;s story on the Department of Justice&#8217;s anti-trust suit against the National Association of Realtors, and I thought: &#8220;Yeehaw!&#8221;<\/p>\n<p>But then I read Glenn Kelman&#8217;s odd rejoicing, and I realized that the &#8220;lawsuit&#8221; is a done deal, and nothing that matters will have changed.<\/p>\n<p><em>Vide:<\/em> From now on we will tinker at the margins about how Buyer&#8217;s Agent&#8217;s commissions are disclosed \u2013 <strong>but we will not have changed the idiotic way Buyer&#8217;s Agents are compensated.<\/strong> Kelman thinks that will make things <em>less<\/em> confusing.<\/p>\n<p>What&#8217;s worse, the &#8220;settlement&#8221; does nothing about the NAR&#8217;s actual, ongoing anti-competitive practices. Cartels are bad, <em>ab initio,<\/em> and requiring membership in a political advocacy group to gain access to a monopoly market is abhorrent to two fundamental American ideals \u2013 freedom of conscience and the freedom to trade.<\/p>\n<p>What&#8217;s better? No matter who &#8220;wins&#8221; this election, Federal courts are all much friendlier to anti-trust cases. And a Biden NFPB will make a beeline for the 1099 safe-harbor exclusion: Wage slaves are union members are Democrats. I&#8217;m hoping for a kinder, gentler NAR for 2021.<\/p>\n<p>So strong my hope, me here yesterday:<\/p>\n<p><strong>Greg Swann:<\/strong> <a href=\"http:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/17492\/making-the-case-for-my-manumission-and-yours-from-the-nar\/\" target=\"_blank\" rel=\"noopener noreferrer\">Making the case for my manumission \u2013 and yours? \u2013 from the #NAR.<\/a><\/p>\n<p>And elsewhere:<\/p>\n<p><strong>Housing Wire:<\/strong> <a href=\"https:\/\/www.housingwire.com\/articles\/doj-sues-national-association-of-realtors-for-alleged-antitrust-violations\/\" target=\"_blank\" rel=\"noopener noreferrer\">DOJ sues NAR for alleged antitrust violations.<\/a><\/p>\n<p><strong>Glenn Kelman:<\/strong> <a href=\"https:\/\/www.redfin.com\/news\/the-truth-comes-out\/\" target=\"_blank\" rel=\"noopener noreferrer\">The Truth Comes Out.<\/a><\/p>\n<p><strong>The Department of Justice:<\/strong> <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-files-antitrust-case-and-simultaneous-settlement-requiring-national\" target=\"_blank\" rel=\"noopener noreferrer\">Settlement Will Increase Competition to the Benefit of American Homeowners and Homebuyers and Allow for Innovation in Brokerage Markets.<\/a> Ahem. <a href=\"https:\/\/www.justice.gov\/opa\/press-release\/file\/1338631\/download\" rel=\"noopener noreferrer\" target=\"_blank\">Read the fine print:<\/a> I think the actual consequential change will be that MLS&#8217;s won&#8217;t be able to lock non-members out of their proprietary lock boxes. Everything else is disclosure and its enforcement, with no change in how Buyer&#8217;s Agents are compensated \u2013 no change in the inverted incentives warping them to better serve the Seller&#8217;s interests, rather than the Buyer&#8217;s.
