{"id":2889,"date":"2008-04-03T13:51:14","date_gmt":"2008-04-03T20:51:14","guid":{"rendered":"http:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/?p=2889"},"modified":"2008-04-03T19:14:18","modified_gmt":"2008-04-04T02:14:18","slug":"nar-news-from-the-legal-front","status":"publish","type":"post","link":"https:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/2889\/nar-news-from-the-legal-front\/","title":{"rendered":"NAR News From the Legal Front"},"content":{"rendered":"<p>Over the years, NAR has had its fair share of legal battles.\u00a0 Currently, there are a few big and interesting cases involving NAR that could have dramatic impact on the real estate industry.\u00a0 Here\u2019s an update on three cases that are in the works.\u00a0 <\/p>\n<p><strong>US<\/strong><strong> vs NAR<\/strong><\/p>\n<p>This is the famous <a href=\"http:\/\/www.usdoj.gov\/atr\/cases\/nar.htm\">case brought by the Department of Justice (DOJ)<\/a> against NAR\u2019s Virtual Office Website (VOW) and Internet Data eXchange (IDX) policies.\u00a0 (Note: NAR has changed the name VOW\/IDX to <a href=\"http:\/\/www.realtor.org\/ild\">Internet Listing Display or ILD<\/a>.)\u00a0 There are two main issues at the core of this suit which is likely to <strong><u>go to trial this summer<\/u><\/strong>.<\/p>\n<ol>\n<li>The IDX opt-out policy is what started the case.\u00a0 The policy allows brokers a blanket opt-out option to keep their listings from being displayed any competitor\u2019s web site.\u00a0 NAR policy also allows brokers a surgical opt-out option where a broker can opt-out of a particular competitors IDX feed (e.g., I will not allow my listings to appear on Swann Realty\u2019s site).\u00a0 The DOJ thinks there should be no opt-out option and that ALL listings should be available for ALL brokers to display.\u00a0 <\/li>\n<li>NAR policy, as proposed, only allows ILD privileges to brokers actively engaged in real estate sales and leasing.\u00a0 In other words, anyone who simply gets the ILD data for the sole purpose of generating leads and is not otherwise involved in real estate would be banned from ILD.\u00a0 The DOJ wants listing data to be like the water that flows from your tap \u2013 available to all.<\/li>\n<\/ol>\n<p>(My prediction: split decision.\u00a0 NAR wins on #1 and loses on #2)<\/p>\n<p><strong>David Berry vs the Entire REALTOR\u00ae Organization<\/strong><\/p>\n<p>I am NOT talking about <a href=\"http:\/\/www.miamiherald.com\/living\/columnists\/dave_barry\/\">Dave Berry the fabulous writer<\/a> for the Miami Herald.\u00a0 This is <a href=\"http:\/\/www.usdoj.gov\/atr\/public\/workshops\/rewcom\/213351.htm\">David Berry the lawyer<\/a> who has made a career of suing NAR.\u00a0 He has tried to have the term REALTOR\u00ae declared generic, attacked MLS membership rules, and numerous other wacky lawsuits.\u00a0 Recently he tried to get a ballot initiative in Maine to legally require all listed properties for sale to be placed in his Open MLS system.\u00a0 NAR and several state associations have fought many legal battles against <a href=\"https:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/2889\/nar-news-from-the-legal-front\/#more-2889\" class=\"more-link\">Read more<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Over the years, NAR has had its fair share of legal battles.\u00a0 Currently, there are a few big and interesting cases involving NAR that could have dramatic impact on the real estate industry.\u00a0 Here\u2019s an update on three cases that are in the works.\u00a0 US vs NAR This is the famous case brought by the [&hellip;]<\/p>\n","protected":false},"author":35,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_crdt_document":"","jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[62,7,29,5,30],"tags":[],"class_list":{"0":"post-2889","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"hentry","6":"category-dirty-laundry","7":"category-enduring-interest","8":"category-group-therapy","9":"category-real-estate","10":"category-supplanting-the-nar","12":"no-featured-image"},"jetpack_featured_media_url":"","jetpack_sharing_enabled":true,"jetpack-related-posts":[{"id":8486,"url":"https:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/8486\/nar-board-sends-idx-policy-back-to-committee\/","url_meta":{"origin":2889,"position":0},"title":"NAR Board Sends IDX Policy Back to Committee","author":"John Rowles","date":"May 17, 2009","format":false,"excerpt":"http:\/\/speakingofrealestate.blogs.realtor.org\/2009\/05\/16\/nars-idx-rule-changes-need-more-study\/ For a few hours there, it looked like the NAR BOD was actually going to do the right thing.
