{"id":3061,"date":"2008-05-06T10:11:44","date_gmt":"2008-05-06T17:11:44","guid":{"rendered":"http:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/?p=3061"},"modified":"2008-05-06T10:11:44","modified_gmt":"2008-05-06T17:11:44","slug":"the-war-against-the-mls-continues-the-mls-must-fall","status":"publish","type":"post","link":"https:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/3061\/the-war-against-the-mls-continues-the-mls-must-fall\/","title":{"rendered":"The War Against The MLS Continues | The MLS Must Fall!"},"content":{"rendered":"<h1><img loading=\"lazy\" decoding=\"async\" align=\"top\" width=\"290\" src=\"http:\/\/www.realestateradiousa.com\/blog\/wp-content\/uploads\/2008\/05\/crosshairs.jpg\" alt=\"Department of Justice Sues the MLS | CMLS\" height=\"322\" \/>\u00a0<\/h1>\n<p>As the real estate industry awaits the long anticipated trial pitting the <a href=\"http:\/\/www.usdoj.gov\/atr\/cases\/nar.htm\">Department of Justice vs. The National Association of Realtors<\/a>, another Multiple Listing Service has been targeted by the DOJ.<\/p>\n<p>On May 2, 2008, the <a href=\"http:\/\/justice.gov\/atr\/cases\/f232800\/232803.htm\">DOJ filed suit <\/a>against the Consolidated Multiple Listing Service (CMLS) of Columbia, South Carolina. The suit challenges the manner in which the CMLS operates and governs its members.<\/p>\n<p>The lawsuit states that CMLS rules unreasonably restricts competition among real estate brokers and has caused consumers in the Columbia area to pay more for the services of real estate agents and brokers.<\/p>\n<p>The lawsuit alleges in part that the CMLS mandates that real estate agents and brokers perform a myriad of obligatory services, which provides for a reduced level of customer service and limits consumer choice.<\/p>\n<p>The suit also states that these mandatory services provides for an exclusion of competitors who might offer innovative options that could provide better services to consumers in that area.<\/p>\n<p><em><strong>&#8220;Buying or selling a home is one of the most significant financial transactions in the lives of most Americans. The kinds of rules CMLS imposes stifle competition to the advantage of its members and the disadvantage of home buyers and sellers,&#8221;<\/strong><\/em> said Thomas O. Barnett, Assistant Attorney General in charge of the Department&#8217;s Antitrust Division.<\/p>\n<p><em><strong>&#8220;Today&#8217;s lawsuit seeks to remove unlawful impediments to competition for real estate brokerage services in the Columbia area, so that consumers will benefit from the additional options and reduced fees that competition can bring.&#8221;<\/strong><\/em><\/p>\n<p>The MLS in most areas allows for the free exchange of information by and between its members regarding available homes on the market.
