{"id":967,"date":"2007-01-29T18:09:38","date_gmt":"2007-01-30T01:09:38","guid":{"rendered":"http:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/?p=967"},"modified":"2007-01-29T18:09:38","modified_gmt":"2007-01-30T01:09:38","slug":"a-selfish-case-for-national-originator-licensing","status":"publish","type":"post","link":"https:\/\/www.bloodhoundrealty.com\/BloodhoundBlog\/967\/a-selfish-case-for-national-originator-licensing\/","title":{"rendered":"A Selfish Case for National Originator Licensing"},"content":{"rendered":"<p>There is a movement to create a <a title=\"csbs\" href=\"http:\/\/www.ofi.state.la.us\/csbsdatabase.htm\">national licensing platform for loan originators<\/a> similar to the one the <a title=\"nasd\" href=\"http:\/\/www.nasd.com\/index.htm\">National Association of Securities Dealers<\/a> (NASD) requires for registered representatives.<\/p>\n<p>Supporters of this movement claim that originators must be licensed because the quality of advice given to the consumer is woefully inadequate.  Those supporters cite a need for background checks, testing for professional competency, and continuing education to protect the consumer against predatory lending and unsuitable loan recommendations.<\/p>\n<p>Opponents of this movement,, most notably, the <a title=\"NAMB\" href=\"http:\/\/www.namb.org\/namb\/Default.asp\">National Association of Mortgage Brokers<\/a>  (NAMB), claim that a national <a title=\"NAMB\" href=\"http:\/\/www.mortgagechronicle.com\/home112406.asp\">licensing platform is &#8220;fatally flawed&#8221;<\/a> because federally-chartered banks and their subsidiaries are exempt from any regulation other than the <a title=\"ots\" href=\"http:\/\/www.ots.treas.gov\/\">Office of Thrift Supervision<\/a> (OTS).  They argue that while they support it in principle, unless the banks &#8220;level the playing field&#8221; , licensing is unfair to the independent originator.<\/p>\n<p><strong>I&#8217;m all for the national licensing, in spite of the controversy, but not for the reasons you might think<\/strong>.<\/p>\n<p>Will national licensing reduce the number of originators out there?  Sure it will. You can&#8217;t swing a dead cat without hitting an originator in Southern California today.  Everybody has a business card with &#8220;mortgage&#8221; or &#8220;financial&#8221; in the company title.  The consumer has never had the number of loan choices as she has today.  Consumers know at least 2-3 people &#8220;in the biz&#8221; and that gives them choices.  I support the effort to nationalize licensed originators because it will dramatically reduce my competition.<\/p>\n<p>Will licensing protect the consumer?  Everybody complains that <a title=\"american\" href=\"http:\/\/www.americancity.org\/article.php?id_article=140\">predatory lending is driving up foreclosure rates<\/a>.  Foreclosure rates are well below that average (although they have significantly spiked from the historical lows of two years ago).  The fact is that over 95% of the mortgagors are doing just fine.  Should the consumer be denied choices and face rising costs to subsidize the fringe borrower in trouble?<\/p>\n<p>Will educational standards increase the service offering to the consumer?  Lending is becoming a specialized business with originators defining certain niches.
